Scope of construction legal expenses coverage

The purpose of construction legal expenses coverage is to provide legal assistance and cover legal expenses for the owner of a dwelling if there are legal proceedings between it and the company that performed the work.

This optional coverage supports the policyholder in seeking recourse from the contractor (craftsman, VSE/SME, etc.) if defects are found, including aesthetic defects (such as difference in level on tilework, etc.).
Claims of a more serious nature having to do with structural aspects and other major real estate property work are not included. Significant damage of this type (structural defects, leaks, etc.) falls exclusively under Structural Damage insurance, which itself is intrinsically linked to Decennial Liability insurance.

Stelliant Loss Adjusting’s work in construction legal expenses coverage

When it is contacted by an individual’s insurer, Stelliant Loss Adjusting sends one of its 250 dedicated Construction experts to the site.

Stelliant Loss Adjusting’s experts are trained in construction problems, but also specialise in applying insurance coverage in the industry and all of the related nuances.

The loss adjuster in charge of the claim does a technical analysis and categorises the various damage. They then identify potential remedies based on the provisions of the contract taken out by the project owner.
If the case is complex, the loss adjuster will call on other specialists within the Stelliant Group to do more in-depth investigations and determine the causes of the incident. This will help establish legal liability.

So, with support from skilled technical, insurance and legal experts, Stelliant loss adjusters advise and support policyholders in seeking compensation from the company liable. Pursuing an amicable solution whenever possible, they play the role of mediator between those involved to reach a mutual agreement that satisfies both insurers and their clients.

Our commitment: to defend our customers’ interests factually and objectively throughout the dispute until the necessary compliance is achieved. Appointed by insurers in cases of legal proceedings, we help the beneficiary and their lawyer, providing technical and contextual arguments to support the case, whether through an amicable or adversarial process depending on what the situation requires.
